Miami-Dade County foreclosure process follows new rules

MIAMI – In an effort to improve and expedite the process currently followed by the County in the enforcement of code violations of vacant houses that are going through a foreclosure process, the Board of County Commissioners, on December 2, 2008, approved Ordinance No. 08-134 sponsored by Commissioner Natacha Seijas, District 13, and Commissioner Carlos A. Gimenez, District 7.

This ordinance establishes a Registry and makes the owner, or responsible party who files a Lies Pendens and/or action for foreclosure upon a mortgaged property, to be responsible for compliance with Chapters 19 and 17A relating to the maintenance of improved and unimproved residential property in Miami-Dade County; providing for the registration of all single family dwelling units that are the subject of a mortgage foreclosure action.

This ordinance, although effective as of December 12, 2008, is still pending the approval of its Implementing Order by the Board of County Commissioners. The Office of Neighborhood Compliance (ONC), which has jurisdiction of this Ordinance, is sponsoring this workshop and welcomes the opportunity to hear comments from interested persons including lenders, realtors and attorneys on Monday, May 4, 2009, at 2:00 pm, at the Jorge Mas Canosa Center. A member of the County Attorney’s staff will also be present to answer any legal concerns.
